Empire co-star Jussie Smollett can exhale now that all of the 16 felony charges leveled against him have been dropped.
Chicago State’s Attorney Kim Foxx’s office said the decision was made in part because Smollett agreed to forfeit his bail money to the city.
“After reviewing all of the facts and circumstances of the case, including Mr. Smollett’s volunteer service in the community and agreement to forfeit his bond to the City of Chicago, we believe this outcome is a just disposition and appropriate resolution to this case.”
According to TMZ, Foxx told Chicago police she was dropping the case because Jussie would have only gotten community service if convicted and she said he has already performed community service so there is no point in prosecuting him.
The cops are reportedly livid over her decision, especially since police brass held a major press conference laying out the case against Smollett.
TMZ could not find any record of Smollett doing community service however.
Foxx’s office said Smollett’s criminal record was “wiped clean” as a result of the case being tossed.
Smollett claimed he was attacked by two MAGA hat wearing white men who threw some chemicals on him while hurling racist and homophobic terms at him.
But Smollett’s story unraveled when two Nigerian brothers who appeared on Empire were caught and quickly admitted being paid by Smollett to help stage the incident.
Smollett has been accused of concocting the incident to try to get more money from Empire producers.
Its unclear how this news impacts Smollett’s place on the show, which has slid in ratings since news of his arrest took over the headlines. Smollett was written out of only two episodes of the show.
Meanwhile, Foxx’s decision to drop all charges once again puts her in the spotlight. Foxx was widely criticized for communicating behind the scenes with an attorney connected to Smollett–and even a relative of his.
Chicago’s police union and many Chicago residents had demanded Foxx recuse herself in the case. She ultimately did, but the decision to drop the case was hers, according to reports.
